Committee procedure

Article 93 is a procedural provision. It states that the Commission shall be assisted by a committee, and that this committee shall be a committee within the meaning of Regulation (EU) No 182/2011. The article addresses only the Commission and that committee: it organises how they work together, not duties for anyone else.

Article 93 does not spell out its own procedural rules; it points to Regulation (EU) No 182/2011 instead. The committee assisting the Commission is defined as a committee within the meaning of that regulation. Paragraphs 2 and 3 then apply Article 5 of that regulation, or Article 8 in conjunction with Article 5, whenever another provision makes reference to them.

Both paragraphs only take effect where reference is made to them. Where reference is made to paragraph 2, Article 5 of Regulation (EU) No 182/2011 applies. Where reference is made to paragraph 3, Article 8 of that regulation applies, in conjunction with Article 5 thereof. The difference is which provision of Regulation (EU) No 182/2011 governs the procedure in each case.
