Article 76

Confidentiality

1.   The discussions of the Board shall be confidential where the Board deems it necessary, as provided for in its rules of procedure.

2.   Access to documents submitted to members of the Board, experts and representatives of third parties shall be governed by Regulation (EC) No 1049/2001 of the European Parliament and of the Council (21)

When are the discussions of the Board confidential?
They are confidential where the Board deems it necessary, so confidentiality is not automatic for every discussion. The conditions are set out in the Board's own rules of procedure, which means the Board itself decides when a discussion is kept confidential.
What rules govern access to documents submitted to the Board?
Access to documents submitted to members of the Board, to experts and to representatives of third parties is governed by Regulation (EC) No 1049/2001 of the European Parliament and of the Council. Article 76 does not create its own access regime: it points to that regulation instead.
Does Article 76 impose any obligations on organisations that process personal data?
